Sony in Class Action Lawsuit over Firmware 3.0

Do you remember when Firmware version 3.0 came out and crashed your PS3? Well John Kennedy sure does and he is really mad about it. Kennedy is the lead plaintiff in a federal class action lawsuit filed against Sony this week in Florida. Thousands of other PlayStation 3 owners say that the mandatory software update irreparably damaged their machines, causing the consoles to freeze and controllers to malfunction. The update was released in early September 2009.

The class action lawsuit names Sony Computer Entertainment America as the defendant. On its corporate blog, Sony acknowledged that the update had produced "isolated issues" for certain users after it was released.

Other plaintiffs complain that a supposed fix from Sony released several days later caused their BluRay drives to malfunction.

Kennedy says that Sony wanted him to pay $150 to repair his damaged console even though the update was a required download.

In the documents, the plaintiffs accuse SCEA of negligence, unjust enrichment, and other counts. The suit is seeking restitution and damages in an amount to be decided at trial, as well as legal fees. If your PS3 console was among those damaged by the firmware update, you might want to watch this case closely.

Wow, a lawsuit... I'm so surprised... Someone should ask this guy if he plans on suing everyone who makes an error. Hey I know lets sue everything that moves!

So, you're saying that if a provider sells us a product which don't works after it updates it, and wants us to pay 150$ to fix his mistake, let's pay!
You should read: "Sony wanted him to pay $150 to repair his damaged console even though the update was a required download."

Uh... no. He bricked his own system because, though it is supposed to be "class action" it has already been found that it wasn't a firmware issue.

Most of it is just Xbots lying about it (see PS3 ads from South America...) or the multitude of other "guerilla" adverts from M$.

I downloaded the update at the beginning of September and my system crashed. I don't have $150 to fix something I am sure was not my fault. It's never overheated before, I have not had one problem, then after downloading the update it crashes and won't start again. A bit fishy if you ask me.

Same here.. Just got uncharte 2 and did the update and now my system bricked as well. System hardly used too. Like brand new.Never moved. Sony rep tried to tell me the laser jumped off track after update. Samething out of warrenty 150 to fix..


Unreal.. Work fine until update 3.01 & reboot.

I just got my system a couple months ago too. I came home from school, downloaded the update, and after I rebooted the system I accessed Playstation Home and my system bricked. I don't want to make Sony go bankrupt or anything. I like their games, and I want them to succeed as a company. I just don't want to pay $150 for something that isn't my fault.

I had the same issue. Downloaded the required download and am now REQUIRED to send sony 169 dollars in Canada to get my 600 dollar system fixed.

I hope some Canadian PS3 owner launches a class-action lawsuit against Sony for the bad firmware.

Users in the PSN forums are split between whether the problem is hardware or firmware.

Sony has been known to use parts of questionable quality, which may have contributed to the demise of many systems. Quality problems can be exacerbated by firmware changes, in the form of stresses and premature failure.

Sony needs to repair all affected systems for free. It is not consumers fault that their expensive game consoles broke immediately after a very specific group of firmware updates.

I'm growing less and less impressed with Sony. Our family used to be a Sony family, now we tend to buy other brands. Sony is one Japanese tech company that will go out of business if they don't address their shortcomings. Too bad too, because the PS3 is a pretty good game console, and the competition doesn't offer the games I like to play, in the quality I've become accustomed to.

I find that this problem is recurring and I don't see why sony won't cop to the issue that they created. My PS3 never froze or had game read errors until I downloaded 3.0 and 3.01 did not fix any of these errors . Out of warranty or not it is SONY's responsibility to clean up the mess, especially since they force their customers to download the firmware.

Is seems people with older systems are being affected. Is it possible they wrote code to ruin older systems, on PURPOSE? Just so that they could sell new systems like the newly released PS3 slim? it seems pretty suspicious, that that all this started happening, just before the release, of the slim which has a working 3.0 version!! They released 3.0 just before they released slim. I call BS too bad I'm Canadian and can't join this class action lawsuit. I hope someone in Canada starts one.

Well I have had my 60gb system since march 2007 and ran like a champ I don't know what happened but I was playing and it just shut down (bricked) on me. the one question I would like to ask to the posters here that have bricked systems is did you have a psp connected for remote play? I never used this feature I activated it mid dec 2009 and last night I had the YLOD and I checked about 15 seconds after it shut down and the system was not even warm same thing out of warrenty $150 to fix it.

I have the same issue as alot of the ppl that have complained about the update bricking there ps3 I have a 60gb that worked flawless untell the 3.0-3.01 updates and my blu-ray has failed Sony needs to man up about this.I don't have many good things to say about Sony right now I know I have owned alot of Sony electronics over the years and will think twice before I purchase from them again.I think Sony is in for a bad profit margin for 2010.I hope they learn to treat there bread and butter better after this.

Sony won't even answer thier phone! They know the jig is up. My station an 80g will not even get online and won't play online games. Even on single player mode. Someone or everyone needs to make an example out of this big corp crimes to it's consumers!

I would like to join this Lawsuit. My ps3 was getting the 8001050f error when trying to get on PSN. The time issue past and then the code changed to 80010514. I have the same issue as Mr. Kennedy and I too am mad as hell because Sony wants me to pay for the repairs. Money is tight and the big company is creating their own income by bugging their own products, then charging for the fix. Everybody with a ps3 should be mad. It my not affect you this time, but give they time and they will get to your systems as well.

My ps3 has the issue with the blu ray drive, hasn't worked for more than 6 months now, and I am definetly not going to pay Sony for a mistake that they caused...

I mad as hell. I'm situated in a country which doesn't have this Sony mechanics. My only option is to get a new one since it broke down a week after the warranty ran out. Whilst Sony aren't acknowledging anything the stores excuse is "Why would Sony put out an update that would cause this trouble?"
Well, why couldn't anybody play a game online because of a clock?
Sony have lost faith from an otherwise loyal consumer.
